1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the iOS and watchOS application "Stress & Nervous System" (the "App") operated by Eagle Tree Inc. ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Not a Medical Device

The App is a wellness and informational tool only. It is not a medical device, and it does not provide medical advice, diagnoses, or treatment recommendations.

The scores, insights, and recovery suggestions provided by the App are based on general wellness principles and publicly available research on heart rate variability and sleep. They are not clinically validated for any individual and should not be used as the basis for any health-related decision.

Always consult a qualified healthcare professional for any medical concerns. Do not disregard or delay professional medical advice because of information provided by the App. In an emergency, call emergency services immediately.

3. Eligibility

The App is intended for users aged 13 and older. By using the App, you represent that you are at least 13 years of age. If you are under 18, you should review these Terms with a parent or guardian before using the App.

4. Health Data and HealthKit

The App requests read-only access to your Apple HealthKit data (including heart rate variability, resting heart rate, and sleep analysis) to calculate your wellness score. Granting this access is voluntary. Denying it will prevent the App's core features from functioning.

You can revoke HealthKit access at any time via Settings → Health → Data Access & Devices. The App will never write data to HealthKit. For full details on how health data is handled, please review our Privacy Policy.

5. Premium Subscription

5-1. Subscription Plans

The App offers a monthly auto-renewing premium subscription that unlocks additional features including extended trend analysis, deep insights, and personalized recovery recommendations. Subscription pricing is displayed in the App prior to purchase and may vary by region.

5-2. Billing

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5-3. Managing & Canceling

You can manage and cancel your subscription at any time in your Apple ID settings or via Settings → [Your Name] → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions of the subscription period.

5-4. Free Trial

Where offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand. Cancellation during the trial will not result in a charge.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• The accuracy, reliability, or completeness of any wellness score, insight, or recommendation
• Fitness for any particular purpose, including medical or clinical use
• Uninterrupted or error-free operation of the App
• Compatibility with all devices or iOS versions

Wellness scores are based on your personal historical baseline and general algorithms. Individual results may vary significantly. Low data availability (e.g., insufficient HealthKit history) will further reduce score reliability.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Eagle Tree Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

1. Your use of or inability to use the App
2. Any health-related decisions made based on information provided by the App
3. Inaccurate, incomplete, or delayed health data retrieved from HealthKit
4. Interruption or cessation of the App or any features thereof
5. Unauthorized access to your device or data

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.

8. Prohibited Uses

You agree not to:

1. Use the App for any unlawful purpose or in violation of any applicable laws or regulations
2. Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
3. Remove, alter, or obscure any proprietary notices within the App
4. Use the App to provide commercial health services without appropriate medical licensure
5. Attempt to gain unauthorized access to any portion of the App or its related systems

9. Intellectual Property

All content within the App — including but not limited to software, design, text, graphics, algorithms, and brand assets — is the exclusive property of Eagle Tree Inc. or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary marks without our prior written consent.

10. Changes to the App and Terms

We reserve the right to modify, suspend, or discontinue the App or any of its features at any time without notice. We may also update these Terms periodically. The updated Terms will be posted with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
